TRYING TO CONVINCE LAWMAKERS THAT THERE WAS A SUITCASE FULL OF DEMOCRATIC BALLOTS IN ATLANTA. THAT THERE WAS SOMETHING WRONG WITH THE VOTING MACHINES. AND WHEN ASKED FOR EVIDENCE ABOUT THIS, HE WAS NEVER ABLE TO SUPPLY ANY DESPITE PROMISES TO. >> AARON, TOMORROW A JUDGMENT HEARING ON THE REQUESTS FROM ABC NEWS AND OTHER MEDIA ORGANIZATIONS SEEKING TO UNSEAL THE AFFIDAVIT ON THE FBI SEARCH OF MAR-A-LAGO. WHAT IS THE LATEST ON EFFORTS TO RELEASE THAT AFFIDAVIT. WHAT IS EXPECTED TO PLAY OUT THERE IN COURT? >> WE KNOW REPORTERS WANT TO SEE IT. WE KNOW THAT FORMER PRESIDENT TRUMP HAS EVEN SAID, SURE, GO AHEAD AND RELEASE IT UNDER REDACTED. KNOWING FULL WELL THE JUSTICE DEPARTMENT IS CONTESTING IT. THE JUSTICE DEPARTMENT SAYS, KENNETH, THERE ARE A NUMBER OF REASONS IT COULD PROVIDE A ROME UP TO ITS INVESTIGATION AND TIP OF PEOPLE WHO ARE UNDER INVESTIGATION WHO MAY NOT NOTICE IT. IT COULD ALSO CHILL COOPERATION FROM POTENTIAL WITNESSES. FOR A NUMBER OF REASONS. THEY COULD GET COLD FEET IF THEY KNOW THEIR NAMES ARE PUBLIC. THEY COULD ALSO BE PUT UNDER THREAT OR PERHAPS UNDER SOME KIND OF VIOLENT ACTION. WE KNOW THAT THE THREATS HAVE BEEN INCREASING AGAINST THE FBI AND GOVERNMENT OFFICIALS AND THE JUDGE INVOLVED IN AUTHORIZING THE SEARCH AND THOSE EVOLVING CARRYING IT OUT. THE JUSTICE DEPARTMENT SAID IT WOULD BE TOO RISKY TO RELEASE THIS PROBABLE CAUSE AFFIDAVIT. EVEN THOUGH IT WOULD UNDOUBTEDLY GO A LONG WAY TO EXPLAINING WHY THE FBI TOOK THIS RATHER EXTRAORDINARY STEP OF SEARCHING THE FORMER PRESIDENTS HOME. >> EXTRAORDINARY INDEED. MERRICK GARLAND SAID HE WAS NOTIFIED TO SIGN OFF ON ALL THIS. HOW MUCH TROUBLE COULD TRUMP POTENTIALLY BE FACING FROM THE INVESTIGATIONS OF CLASSIFIED DOCUMENTS AT MAR-A-LAGO? >> THERE'S REALLY NO WAY TO KNOW. IT COULD COME DOWN TO A MATTER OF INTENT. EVEN IF HE DID NOT MEAN TO STORE THE DOCUMENTS, MAYBE IT WAS JUST SLOPPY. ALTHOUGH SLOPPINESS AND CLASSIFIED INFORMATION DON'T NECESSARILY MIX. WE ARE REALLY IN UNCHARTED TERRITORY THOUGH. THEY ARE YET TO PROVIDE ANY EVIDENCE OF A RECORD OF DECLASSIFICATION OF THE WAY HE HAS ANOTHER MATTERS. THE SUPREME COURT HAS WRITTEN AN OPINION ABOUT IT THAT SAYS THE COMMANDER-IN-CHIEF HAS BROAD AUTHORITY TO DECLASSIFY DOCUMENTS THAT MIGHT RELATE TO NATIONAL SECURITY IF YOU WANT SOME DECLASSIFIED. NONE OF THE PROCEDURES IS TERRIBLY CLEAR. IT MAY WELL GIVE FORMER PRESIDENT TRUMP SOME KIND OF OUT. ON THE OTHER HAND, WHETHER THE DOCUMENTS ARE CLASSIFIED OR NOT MAY NOT EVEN MATTER. THE ISSUE COULD WELL BE THAT THEY WERE REMOVED FROM THEIR RIGHTFUL PLACE IN WASHINGTON TO BEGIN WITH. THEY ARE NOT THE FORMER PRESIDENT'S PERSONAL DOCUMENTS.
